Terms of Service
The Gallery
Your online gallery will be available for 12 months from the date of upload. After this period, the gallery will be removed from the system.
If you require access beyond the initial 12 months, an extension can be arranged for a fee of £40, which will provide an additional 12 months of access.
It is the client’s responsibility to download and back up their images within the initial 12-month period. Once a gallery is removed, retrieval may not be possible.
Client Usage
The Client is permitted to use digital files strictly in accordance with the terms of this agreement. These files are intended solely for personal use unless a separate written licensing agreement is established between the client and the photographer. The client is not allowed to submit digital files to contests, reproduce them for commercial purposes without prior consent from the photographer, or permit any reproduction by parties other than the photographer.
Martin Carter Photography grants the Client a non-exclusive, non-transferable, perpetual license for personal use to reproduce digital images through print or other physical media. This license is valid for non-commercial activities, including reprints, enlargements, gifts to family and friends, slide shows, and web pages. For any commercial use, the client must negotiate and obtain a written licensing agreement from the photographer prior to such use.
Social Media
The client may share blog post links and Facebook albums using the platform's share functions and by distributing direct links. If stipulated by the contract, all images posted on social media must include a direct link or credit to Martin Carter Photography. The client is not allowed to copy, screenshot, or otherwise capture the photographs, nor to significantly crop, edit, or add filters to them.
Permitted uses
Personal, Non-Commercial Use:
Display on personal websites and computers.
Print images or create other physical media for personal use.
Commercial Use:
Promote via website and social media according to a written contract between the client and the photographer.
Create other promotional content with the express written permission of the Photographer.
Prohibited Uses
The client may not:
Resell, relicense, sublicense, or redistribute the digital files without the Photographer's express written permission.
Use the digital files in an obscene, illegal, immoral, libelous, or defamatory manner.
Incorporate the digital files into trademarks, logos, or service marks without the photographer's express written permission.
Martin Carter Photography and its vendors are not liable for any third-party claims or incidental, consequential, or other damages arising from this license or the Client's use of the digital files.
License
All images captured by Martin Carter Photography are the exclusive property of Martin Carter Photography and are protected by copyright law. No images may be copied, utilised, or published for commercial purposes without explicit permission from Martin Carter Photography. Martin Carter Photography retains the right to utilise any images of the client for its website, blogs, or any other associated marketing materials.
